TERMS AND CONDITIONS
These terms and conditions (Terms) apply to all bookings with Stillwood Retreat and you.
Please read these Terms carefully prior to booking. By booking directly with us, you agree that you have read and agreed to comply with these terms and conditions.
These terms may be updated at any time and will be posted on our website.
Fees
a) The entirety of the fees for your stay must be paid at the time of booking.
b) Payment must be made via bank transfer or any other method of payment as notified to you.
Cancellations
The following applies to all cancellations inclusive of any Covid19 related situations. We highly recommend that you take out your own travel insurance to cover any unforeseen circumstances.
a) For cancellations made with notice of 30 days’ or more, a refund will be issued minus a cancellation fee of 30% of your booking will apply.
b) For cancellations less than 30 days there will be no refunds issued and 100% of funds will be forfeited.
Refunds
a) We do not offer refunds for no-shows, change of mind, or if you or any Guest does not stay at Stillwood Retreat for the entire stay period.
Checking in and out
a) Check-in time is 3:00pm WST.
b) Check-out time is 10:00am WST.
c) We may allow, at our sole discretion, allow for earlier check-in and later check-out times.
d) Guests must leave Stillwood Retreat in a clean and tidy state. If the property is not in a clean and tidy state upon departure, we may charge you an additional cleaning fee at our sole discretion.
Guests and visitors
a) The maximum number of guests is two and this number must not be exceeded at any time during your stay.
b) The full names of guests must be provided at the time of booking.
c) All guests must be over the age of 21.
d) Visitors are not permitted to Stillwood Retreat, unless our prior written consent has been obtained (which may be withheld in our absolute discretion). It is the responsibility of guests to ensure that any approved visitors comply with these terms and conditions.
e) No parties or functions of any kind (including, but not limited to, hens’ nights and bachelor parties) are permitted on Stillwood Retreat, unless our prior written consent has been obtained (which may be withheld in our absolute discretion).
f) No smoking in or around the property.
No children and pets
No children and pets are allowed on Stillwood Retreat at any time.
Your stay
a) We have lovingly furnished Stillwood Retreat with carefully curated items and furniture. Guests agree to look after all furnishings and items in Stillwood Retreat.
b) Please report any breakages of items to us as soon as possible. We may charge guests a fee for the replacement of such items.
c) Guests must not rearrange any furniture or fixtures on the property.
d) Guests must not remove any furniture or other chattels from the property upon departure. If any such items are missing after departure, we may charge you a reasonable fee for the replacement of said items.
e) ·The bedroom is accessible on the mezzanine level, accessed only via a spiral stair case and as such isn't suitable for those with access or mobility issues.
The Property
a) No swimming, diving, fishing or any aquatic activities of any kind are permitted in the dams present on the property.
b)· As we are in a rural location, seasonally, we may experience heightened levels of pests and while the property is professionally treated periodically we are unable to control endemic bugs on site (especially if windows/doors are left open). Bug spray is provided for guest use.
Noise
a) Guests are requested to respect neighbouring properties and keep noise to a minimum.
b) Unreasonably loud noise after 10:00pm WST will not be tolerated. Guests in breach of this section may be asked to leave Stillwood Retreat at any time and no refunds will be provided.
Commercial activities
No commercial activities of any kind (including, but not limited to, photoshoots and video shoots) are permitted at Stillwood Retreat unless our prior written consent has been obtained (which may be withheld in our absolute discretion).
Waiver of liability
Stillwood Retreat disclaims all liability for any loss or damage (including consequential loss) to all guests and their property during their stay at Stillwood Retreat.
Governing law
a) The laws of the State of Western Australia govern these terms and conditions.
b) Each party irrevocably submits to the exclusive jurisdiction of the courts of Western Australia and the courts of appear from them in respect of any proceedings arising out of or in connection with these terms.
General
a) No party may rely on the words or conduct of any other party as a waiver of any right unless that waiver is in writing.
b) A party cannot assign, novate or other transfer a right or obligation under these terms and conditions without the prior written consent of the other party.
c) Any term and condition which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable.
